General Terms of Use

1. Purpose

These General Terms of Use set out the rules for using the website imbt-consulting.com (the "Website") and the online services offered by IMBT Consulting: appointment booking, client space, digital diagnostic, shared tasks and contact form.

2. Definitions

• "Publisher": IMBT Consulting, which publishes and runs the Website.
• "User": anyone who visits the Website, with or without an account.
• "Account holder": a User who has created an account and uses the client space.
• "Client": the person or company that has ordered a service from IMBT Consulting. Services are governed by the General Terms of Sale and the signed quote, not by these Terms of Use.

3. Acceptance

Using the Website means complying with these Terms of Use. Creating an account, including with a Google account, means accepting these Terms of Use and the privacy policy.

Creating an account does not commit you to buying any service.

4. Access to the Website

The Website is free to access. The Publisher strives to keep it available at all times, without being able to guarantee it: it may be interrupted for maintenance, updates or in the event of a failure. Internet connection costs are borne by the User.

5. Account

To create an account, the User provides accurate, up-to-date information and chooses a password of at least 10 characters. An e-mail address can be linked to only one account.

• An e-mail is sent to the address provided: the User confirms the address by clicking the link received. The account can only be used (signing in, booking appointments) after this confirmation.
• Anyone who receives this e-mail without having created an account can report it with the link in the e-mail: the account is then blocked and the Publisher is informed.
• The password is personal and confidential. The Account holder is responsible for the use of the account and informs the Publisher immediately of any unauthorised use. Sessions on other devices can be closed from the client space.

6. Client space services

• Appointments: the Account holder can book an appointment, then cancel or move it up to 24 hours before the scheduled time, with a maximum of two moves. A moved appointment must be confirmed again by IMBT Consulting.
• Tasks: the Account holder can create private tasks, or tasks shared with the IMBT Consulting team.
• Digital diagnostic: the result (score, levels and advice) is calculated automatically from the answers given. It is provided for information only and is neither an audit, nor personalised advice, nor a commitment to results.
• E-mails: the Account holder receives the e-mails related to the account and appointments (confirmation, reminder, move, cancellation).

7. User obligations

The User undertakes to use the Website fairly and in accordance with the law. In particular, the User shall not:

• provide false information or use another person's e-mail address;
• book appointments they do not intend to attend;
• send abusive, advertising or automated (bot) messages;
• attempt to access the Website, its data or other people's accounts without authorisation, or disrupt its operation.

8. Intellectual property

The texts, logos, visuals, articles and other elements of the Website belong to IMBT Consulting or to their authors. Any reproduction or reuse without written permission is prohibited.

The photos illustrating some articles come from image libraries: their authors are credited and remain their owners.

9. Personal data

Data collected on the Website is processed in accordance with the privacy policy, which sets out the purposes, retention periods and the User's rights (access, rectification, objection, deletion).

The Account holder can update their information in the client space and request the deletion of their account from the Profile tab.

10. Liability

Information published on the Website is general in nature. The Publisher cannot be held liable for an interruption of the Website, for use contrary to these Terms of Use, or for the content of third-party websites that links point to.

Decisions made on the basis of the digital diagnostic or the articles are the sole responsibility of the User.

11. Suspension and deletion of the account

The Account holder can request the deletion of their account at any time. In the event of a breach of these Terms of Use or fraudulent use, the Publisher may suspend or delete an account, informing the Account holder where possible.

12. Paid services

Consulting, development, training and marketing services are subject to a quote and are governed by the General Terms of Sale.

13. Changes to the Terms of Use

The Publisher may amend these Terms of Use, in particular to take new services into account. The applicable version is the one published on this page, with its effective date.

14. Governing law and disputes

These Terms of Use are governed by Tunisian law. In the event of a dispute, an amicable solution will be sought first; failing that, the dispute will be brought before the competent courts of Tunis.
